1. About These Terms

These Terms of Use govern access to and use of the Badgie Academy website and learning platform ("Badgie Academy," "we," "us"). By accessing Badgie Academy, you agree to these terms. If you are accessing Badgie Academy on behalf of a school, district, or organization, you represent that you have authority to agree to these terms on that organization's behalf.

These terms apply during the current pilot phase. If terms change in future versions, updated terms will be posted with a new effective date.

2. Permitted Use

Badgie Academy is provided for educational purposes. You may access and use Badgie Academy to:

• Engage with K–12 cybersecurity, AI literacy, and technology career readiness curriculum
• Facilitate classroom, homeschool, or program learning experiences for students
• Preview lessons and instructional materials as a teacher, administrator, or parent
• Share lessons with students in supervised educational settings

3. Prohibited Use

You may not use Badgie Academy to:

• Scrape, copy, redistribute, or republish curriculum content for commercial purposes without written permission
• Attempt to reverse-engineer, modify, or interfere with the platform's operation
• Use the platform in any way that violates applicable law, school policy, or these terms
• Misrepresent your affiliation with Badgie Academy or use the Badgie Academy name, logo, or curriculum without authorization

4. Student and Minor Use

Badgie Academy is designed for supervised use by K–12 students under the oversight of teachers, parents, or other qualified adults. School and program administrators are responsible for ensuring that student use of Badgie Academy complies with applicable school policies, parental consent requirements, and applicable law.

Students do not create accounts and do not supply personal information. Teachers and parents do create accounts, which store an email address and a hashed password. See the Privacy Policy and Student Privacy page for what is stored, how long it is kept, and how to have it deleted.

5. Intellectual Property

All Badgie Academy curriculum content, including lesson text, instructional design, character artwork, module structure, facilitation guides, and supporting materials, is the property of Badgie Academy and is protected by applicable intellectual property law.

Schools and teachers may reproduce Badgie Academy content for direct classroom use — printing lesson materials, sharing parent letters, distributing facilitation guides — without separate permission. Reproduction for commercial distribution, resale, or use outside of direct educational delivery requires written permission.

6. No Warranties

Badgie Academy is provided "as is" and "as available" during the pilot phase. We make no warranty that the platform will be uninterrupted, error-free, or free from technical issues. Educational content is designed to be accurate and age-appropriate, but Badgie Academy does not warrant that all content is complete, current, or suitable for every learning context.

Schools and educators are responsible for reviewing content for appropriateness within their specific student populations, grade levels, and community contexts before use.

7. Limitation of Liability

To the extent permitted by applicable law, Badgie Academy is not liable for indirect, incidental, or consequential damages arising from use of or inability to access the platform. Badgie Academy's liability for any direct claim arising from these terms or use of the platform is limited to the amount paid for the service — which is zero for the current free pilot.

8. Third-Party Services

Badgie Academy uses Google Fonts for typography and is hosted on Cloudflare's content delivery network. These third-party services operate under their own terms and privacy policies. Badgie Academy is not responsible for the practices of third-party service providers.

9. School and District Agreements

Schools or districts that require a formal vendor agreement, data processing addendum, or memorandum of understanding before deploying educational technology should contact Badgie Academy before piloting. None has been executed with any district to date. We will work with school partners on the terms they need.

10. Changes to These Terms

Badgie Academy may update these terms as the platform evolves. Material changes will be communicated to schools and pilot partners by email. Continued use after an update constitutes acceptance of the revised terms.

11. Governing Law

These terms are governed by applicable law. Any disputes arising from these terms or use of Badgie Academy should first be raised with us directly at BadgieIQ@proton.me so we can work toward resolution.
